The claim was lodged this morning at the courts of Donostia. In addition to CAF, the lawsuit targets Azpeitia Hermanos, Montajes Nadur, Iberica de frio, Plasticos ABC Spain, Onena bolsas de papel, and Volkswagen Navarra. Asviamie, the Basque association for asbestos victims, stated that the companies are accused of "failing to comply with safety regulations regarding asbestos and for the damages and subsequent death caused by the work".
The former employee, identified as Honorio B., worked at CAF as a turner from January 1974 to March 1986. He was diagnosed with pleural mesothelioma in 2024. Asviamie specified that "the worker was exposed to asbestos during his tenure at CAF, working as a turner in section 144".
A report from the Navarrese Health Service, issued on February 13, 2025, suggested that the workplace could be the origin of the pathology. The report, after detailing the work performed at CAF and the other companies involved, concludes: "It is likely that the mesothelioma is related to asbestos exposure. Mesothelioma is the best marker for asbestos exposure, as it is an uncommon neoplasm in the general population and the primary risk factor is such exposure".
This morning, the association Asviamie held a gathering in front of the courts to show support for the family's lawsuit.
