The company Residencial Finca Pons, S.L. has made public its complaint about the urban blockade situation affecting the Marymontaña II sector in Altea. This area, paralyzed since 2008, shows over 80% execution according to municipal documentation, but suffers from neglect, vandalism, and a notable lack of administrative oversight.
The developer recalls that the municipal plenary session of June 22, 2017, resolved the adjudication of the Integrated Action Program, seized the previous developer's bond, and agreed to initiate a new programming of the land. However, nine years later, this new programming has not been promoted or completed, leaving property owners in a legal limbo.
Residencial Finca Pons, S.L. emphasizes that institutional responsibility cannot be hidden, as municipal reports signed by political and technical officials acknowledge the lack of progress. These reports include those from Inmaculada Orozco Ripoll (then Urban Planning councilor), the Head of Urban Planning, municipal architect Ana Beltrí Izquierdo, Head of Urban Planning and Environment Service, Estefanía Martínez Martínez, and a General Administration Technician who in 2026 reported on the persistent blockade.
For the developer, these documents demonstrate that the Altea City Council was aware of the sector's unfinished state and has not taken effective measures to reactivate it or allow alternative solutions.
The company recalls that property owners have fulfilled all urban planning obligations, including the transfer of public land and the equitable distribution of benefits and burdens. The Reparcelling Project, approved on August 11, 2006, and registered in the Property Registry, confirms that the area was interrupted by the administration, not abandoned by individuals.
In the specific case of Residencial Finca Pons, S.L., documentation shows that the plot paid 100% of the urbanization fees and has the necessary basic infrastructure, with only finishing or connection works pending. This reinforces the complaint of a disproportionate blockade by the City Council.
The developer also complains that the City Council has not formalized the reception act of the urbanization, an essential procedure that should have been carried out based on the technical report of December 5, 2016. For Residencial Finca Pons, S.L., this constitutes abnormal administrative functioning.
Residencial Finca Pons, S.L. demands that the Altea City Council identify those responsible for the administrative inactivity, explain the destination of resources and guarantees linked to the old program, including the seized bond and income from the sale of the 10% municipal development share, and adopt a legally viable solution to unblock the plots and guarantee property owners' rights.
The developer concludes that Marymontaña II “cannot remain trapped in an urban limbo that violates legality and severely harms those who fulfilled all their obligations”.
